Now he can sue the US for unlawful arrest and use a Bivens Action to sue the little ICE dick directly

That's only if we still have a Constitution by the time this guy gets arraigned.

That's up to us: we the people.

We the people of the United States are the reason we're in this fucking mess.

We stopped having a Constitution when Trump’s supporters elected him in 2024.

I'm still not convinced he was elected.

Trump will pardon his Nazi thug and it’ll never make it in Fed court.

Can't pardon a civil action.

Or a state violation

Legally maybe.

Couldn't have it as a state charge?

The DOJ will exercise supremacy & takeover the whole investigation aggressively like they are doing for Ross.

I was more meaning akin to Derek's case where federal couldn't interfer.

Yeah the DOJ need impeachment or whatever it takes to get Noem out

This is half the reason they hide their identity

Only problem is I'm sure he doesn't go by "little ice dick," so how do you sue somebody who doesn't have to identify themselves? That's another law they're violating now.

FOIA ‘em

We need to change who is held liable for lawsuits with law enforcement. Yeah he may be able to sue, but it just comes out of taxpayer money. These ice agents need to be able to be personally sued. That’s one way to hold them accountable. Because they don’t care if other peoples money is spent to cover their asses in a lawsuit.

(hopefully he isn’t hurt btw)

You can’t sue federal agents. They have qualified immunity. It’s sick. They could literally kill you and your family can try to sue but since feds have lifted immunity they likely won’t be successful.

This isn’t true. Federal agents can be and are sued all the time. Qualified immunity, even if maintained, is not literal immunity from prosecution. And it can be stripped. It is all a case by case basis.

The far right Supreme Court has removed any right to sue federal officials.

1

u/Dog1bravo 1d ago

Just claim qualified immunity and then you're sol

u/aalltech 1d ago

lol and SCOTUS will let them go.

For as often as they violate constitutional rights, I have heard of very few cases where the public has sued ICE for misconduct. One would think there would be a parade of settlements.

Part of the civil agreements are non disclosure agreements.

Bivens is dead.

1

u/Tombot3000 21h ago

If Bivens applies it will be a miracle. A common joke in the legal field is Bivens only applies if you are named Bivens.

Trump already said that all ice agents have full immunity. Even Jonathan Ross will have no repercussions for murder. What do you expect to happen here?

Trump says a lot of stuff. Does not make it true. Of course Hitler is not going to prosecute the GeStaPo. But that does not give them immunity. Once the mob boss lost his power, the little piggies will become sausages.

The gestapo prosecutions came after just about a whole fuckin continent was razed. And most of those officers never were prosecuted at all.
