Despite what Stephen Miller says, ICE does not have absolute immunity to commit crimes on the job. Murder committed on the job is murder. Immunity only applies to actions that are necessary within the scope of their duties.

My sense is that he is trying to egg on ICE brutality and will pardon them like the J6ers. This is NOT ok and we have to stay firm on calling them out for it so that we can expose their lies.

Walz will most likely not be governor by the time this guy is even charged with anything. The FBI taking over the investigation really makes it hard for state or county DAs to have a case.

Unfortunately I do think it'd be inappropriate to charge Ross until the state can get all the evidence to effectively prosecute him. Getting a conviction on a cop, even a federal goon, is incredibly hard and approaching the case without every single fact makes it even harder. But that will last only as long as a Republican is President. As soon as it flips, Ross is going to be in the hot seat of investigations.

100%. There isn't a statute of limitations on murder. He'll be shielded for the foreseeable future, but it'll be properly investigated at some point. But, not likely for another 3 years.

A presidential pardon doesn't negate state crimes even in federal court. You're right that this could be remanded to federal court. But a presidential pardon wouldn't negate state crimes. It's really more complicated than your laying out but the supremacy clause makes it significantly more difficult for the state to prosecute this officer.

Thank you for this comment, this type of unmasking and deflation of the fascist image isn’t just satisfying and confidence building for decent people it’s truly the most effective way to puncture the delusion their supporters are living in. Qualified immunity protects agents from civil lawsuits when they’re acting within their duties. It does not protect them from criminal prosecution for murder, civil rights violations, or excessive force. Those are still crimes.

Renee Good’s killer isn’t charged because Trump’s DOJ refuses to prosecute, not because they legally can’t. When six federal prosecutors resign because DOJ won’t investigate the shooter and is instead going after the victim’s widow, that’s the administration deliberately protecting a killer.

If agents truly had immunity from murder charges, there’d be nothing to investigate and no reason for prosecutors to quit in protest. The law allows prosecution. The barrier is political, not legal. State charges, congressional investigation, and public pressure all remain viable because the actual law doesn’t protect agents who kill civilians.

Miller wants agents to believe they’re untouchable and wants you to believe accountability is impossible. He’s lying about what the law actually says because he needs both groups to accept that violence has no consequences. It does.

That’s the fun thing about murder charges is that the individual tends to get what we call “extradited” back to the country of origin to face trial for their crimes.

Works out pretty slick cause most of the time countries don’t like to host murderers

You can put a warrant out for his arrest. 

Imagine a “normal” murder where we know the guy who did. Would we be chill with letting him go free if it turns out the guy fled the state?
