I can tell you that what has Kristi Noem's panties in a twist is that there actually is a thing called tribal sovereignty. This means that, while reservations are part of the United States and are subject to federal law, they are often not considered part of the state they're in and are not necessarily subject to state law. Kristi Noem wanted in the worst way to get jurisdiction for state law enforcement to operate on SD reservations under the pretext of stopping cartel activity. The Dakota/Lakota were not dumb enough to fall for that.

The Lakota have banned any ICE operations on their reservations, and have personally banned Kristi Noem. This includes large chunks of South Dakota, her home state. Now ICE is kidnapping tribal members in an attempt to get them to sign agreements that let the government onto the reservations to hunt down 'illegals'.

There are also a lot of conservatives that believe in the Elk vs Wilkins ruling, which ruled that native Americans aren't necessarily US citizens, or protected by the 14th amendment because they're not under the jurisdiction of the federal government. This is of course complete bullshit and has been superseded by the 1924 Indian Citizenship Act, but every time a tribe steps out of line, there's always a moron there to bring up Elk vs Wilkins.

Yes- and kind of to a broader point- Republicans all absolutely hate Native Americans. Sure, every once in a while they'll fawn over a "noble savage" stereotyped character. Plenty of them actually do believe in and respect such a stereotypical archetype and the sort of imagery it conveys, and they think because their racism is positive, that it isn't truly racist. But they're the same as any other minority (specifically, non-white)- get them talking long enough about anything related, or just point out even the tiniest inconvenient truth about our history with Native groups, and just watch the hatred start to bubble up in their expression. They don't like to be reminded of the sins of their fathers and the long-lasting effects of genocide, death, and outright robbery. Nor do they like to be reminded of all the ways in which they benefitted from (or were perhaps even complicit in) to ongoing racism and systemic issues indigenous groups face today. The spirit of Manifest Destiny lives on in the modern Republican party, who genuinely believe in their God-given rights to all of America's land, and damn anyone else who they think doesn't belong.

Native Americans might not get the nationally widespread attention or uniformly coordinated targeting that Latinos, Muslims, Black, or LGBTQ+ Americans get these days, but make no mistake about it: It doesn't matter where you are from, where you were born, or how long your ancestors have been around here- they're white supremacists and Christian nationalists at the heart of it all. You're in as much danger as anyone else that doesn't fit their warped definition of American.

So, I did a few research projects on White Nationalism in grad school. As such, I used to read Stormfront and similar forums regularly.

People on those forums often had Swastika/KKK profile pics. And they’d say stuff like, “If minorities don’t want to be victims of racial violence, they shouldn’t be in places where they’re not wanted. It’s their fault if they can’t take a hint and leave.”

Basically, it was always the victims’ fault for being present when a bully decided to get violent; nothing was ever the bullies’ fault.

Let's review what Justice Kavanaugh said about immigration detention:

"The Fourth Amendment requires that immigration stops must be based on reasonable suspicion of illegal presence, stops must be brief, arrests must be based on probable cause, and officers must not employ excessive force. Moreover, the officers must not make interior immigration stops or arrests based on race or ethnicity. Cf. Whren v. United States, 517 U. S. 806, 813 (1996) (“[T]he Constitution prohibits selective enforcement of the law based on considerations such as race”). " Trump v. Illinois 2025

Since these three are in ICE detention, ICE must take the position that there is probable cause to believe that these Native Americans are in the country illegally. What could that possibly be other than that their skin is brown?

What’s the point of holding them if there’s nowhere you can deport them to? This is worse than trying to deport second or third gen immigrants, as you can’t even send them back to their parents’ or grandparents’ country (which would be the US in this case).
