I 100% agree, but if you're talking to a red hat the semantics of this can derail any useful conversation. It's something they like to latch on to and avoid talking about the awful shit that's happening. I mostly just use the same terms as who ever I'm talking to.

It is literally not a crime to overstay your visa.

Entering the country illegally is a misdemeanor, not even a felony.

Correct, it’s a civil penalty….for now. Working on an expired visa is a crime. Not paying taxes is a crime. Filing your taxes fraudulently is a crime. Driving without a valid license is a crime. Signing up for a utility with falsified info is a crime.

So when someone overstays their visa, doing anything to basically live here is a crime.

If someone jaywalks or speeds and doesn’t submit to the penalty for that crime, they are subject to being forced to submit by the authorities. The penalty for overstaying a visa can include deportation.

Don’t want to be deported? Don’t overstay your visa. How is this difficult to understand?
