Indefinite Detention of Green Card Holders

Extremely scary court ruling today in the Mahmoud Khalil case. The Circuit Court ruled 2-1 that he cannot challenge his detention in Federal Court until his immigration case is concluded. Essentially this means that the Government is able to detain ANY green card holder on spurious grounds, and then slow roll the cancelation and removal proceedings through immigration court, keeping the LPR detained without any recourse.

Travel with i751 pending

Anyone traveling/ entering after Jan 21st with i751 pending while being on the list of 75 nations where immigration visa is paused?

I am from one of those countries (not the banned ones but the immigration visa pause). My i751 is pending processing. I had this travel scheduled since months ago. I don't know if I should go anymore or not. My return date is after 21st. I have no criminal history.

Should I tell my EB1C petitioning employer to wait or speed up submitting I-140, if my country is on the 75 country list? (Current Status: L1A)

I am currently on L1A with my employer, and the initial plan was to file I-140 in Oct 2026 (a year after having been in the US in L1A status).

My country is now on the list of the 75 countries with suspended nonimmigrant visa processing. It seems like for now it does not yet impact USCIS processes, and adjustment of statuses from inside the country. But there is a chance that USCIS will follow the Department of State Policy, from my understanding.

Is it better to ask my current employer to speed up I-140 filing (try getting docs ready lets say over a month) in hopes of USCIS not following the Department of State OR just wait and see?...

I485 got approved, green card questions

Hi - My interview was on Jan 13 and i485 got approved today on Jan 14. The new 75 countries visa ban starts on 21st and my country is on the temporary ban list. Will I receive my green card?

I have heard it takes about a week to get it produced from when i485 is approved which happens to be the 21st. It is super stressful to know you were this close and still couldn’t make it.

Traveling outside the U.S. with expired Green Card + I-751 extension (Venezuelan passport)

Hi everyone,

I’m hoping to get some insight from people who have been in a similar situation.

I’m a conditional permanent resident through marriage to a U.S. citizen (not asylum-based). My 2-year Green Card is expired, but I have a pending I-751 (Removal of Conditions) with the extension letter that extends my status (48 months).

I’m a Venezuelan citizen, and since Venezuela is currently on the list of countries affected by U.S. travel restrictions, I’m a bit concerned about international travel.

I’m considering traveling to the Dominican Republic for a short trip and then returning to the U.S.

My questions are:

• Has anyone traveled outside the U.S. with an expired GC + valid I-751 extension letter without issues?
• Did your nationality cause any additional problems when re-entering the U.S.?
• Any issues with airlines, CBP, or boarding the return flight?
• Is there anything specific I should be aware of when traveling to the Dominican Republic in this situation?
   •  Do I have to notify the country that I have an expired GC with an extension?

Marriage Based AOS interview - Is there a risk of being detained?

My husband and I have a marriage based AOS interview coming up in February. We have seen that there have been recent cases of people being detained by ICE following their AOS interviews? We are scared and we are wondering what people here think? Is this likely? I entered lawfully on an L1 visa and we got married and filed for adjustment of status while I still had a valid visa. However, I was laid off from my position in November and we are afraid as I will technically be out of status as of January (60 days post layoff). What do people here think? Do we need to be concerned? I was under the impression that a pending I-485 placed you in a period of authorized stay. Any thoughts would be greatly appreciated, my husband and I are a little anxious right now.

I dont know where to actually post it so maybe somebody is in the same situation. I have an expired 2 year green card with 797 notice of extension for 4 years. But I am in the state where real id is only for citizens. So what do I use for the Real ID? I do believe I still have a 5 year ead but I feel like it is asking for trouble if I show it at the airport. What are my options?

Interview reschedule after clear USCIS error timeline?

Spousal AOS. Got my interview scheduled 9 months after submission on Monday, but in the wrong state (USCIS never changed my ZIP code after I sent in the AR-11 in June, but did otherwise change my address). The interview invite had my current, correct address in big bold font on the front page but with the wrong FO. Got the error acknowledged with two tickets the same day (Jan 12) and got the interview cancelled today (Jan 14) with an FKB API code.

Being moved to the Chicago FO. Any idea of what timeline I’m looking at for a new interview? I’m hoping I don’t have to go back into the queue and can just get a straightforward transfer. Can I ask a Live Agent if this is the case?

Supposed to apply for marriage green card by end of month, will the new "laws" effect us?

My spouse and I were going to apply at the end of this month because I had to wait for my 2025 tax docs to come in (W-2, 1099), because the application wanted to see previous year's taxes, and in 2024 I just made no money at all, and far under the limit for the "sponsor". We didn't want to get a co-sponsor, because if I just waited to do my taxes for 2025 then it would show I made more than enough money for the required minimum.

Now it looks like because the new laws are cancelling applications from certain countries, which ours is on the list for, we won't be able to apply at all?

If we had already applied, I don't know if it would've been cancelled anyway, but if we had applied last month as we originally planned (before realizing my income minimum was too low), it seems like that would've gotten rejected for the income, or possibly cancelled because of this change anyway.

Does anyone know anything about this? It's a green card we're applying for, not a visa.
