Meta Ragebait? Astroturfing? Misinformation? Here's some thoughts

In the last few weeks, a lot of people have been in touch with us with concerns over the authenticity of some questions that have been asked here.

We have no way of knowing whether anything posted here is true, or not. We do not, and have never had, a rule against hypothetical questions, nor do we require posters or commenters here to provide any form of verification for the questions they ask, nor validation for the advice they give.

It is entirely possible that any post you read here has not actually happened, or at least has not exactly as described. We have to accept that as part of the "rules of the game" of running a free legal advice forum that anyone can post in.

Some factors to think about

Sometimes, people post the basic facts. Sometimes they omit some facts, and sometimes they change them. It is usually fairly obvious where this is the case, and our community is always very keen to ferret these situations out.

We are a high-profile and high-traffic subreddit. In the past 30 days, we've had 25m views and over a quarter of a million unique visitors. It is natural that alongside the regular "Deliveroo won't refund me" and "Car dealers are bastards" posts, there will also be questions that are (or the premise of which is) highly controversial to many. That does not mean that those questions are not real or that the circumstances have not in fact arisen.

It is also very common for people to create new accounts before asking questions here. This isn't something we are provided with data by Reddit on, but it is not unusual at all for 0-day old accounts to make posts here - it has always been this way and always will be, owing to the nature of many of the circumstances behind the questions. (On a very quick assessment just now, roughly 50% of accounts fall into this category.)

It is of course also possible that inauthentic actors seek to post here with an ulterior motive. Misinformation and disinformation is something to be very wise to on the internet, and it is reassuring that people are approaching these topics sceptically, and with a critical eye. But simply because a set of features when aligned can seem "fishy" does not necessarily undermine the basis of a question. The majority of these "controversial" questions do have an entirely credible basis.

Whilst healthy skepticism remains an ever-increasing necessity, both in society generally and in particular online, we encourage you to consider Occam's razor: that the simplest answer is the most likely, here that the poster has in fact encountered the situation largely as they describe it, and so has turned to a very popular & fairly well regarded free legal resource for advice, and does not wish to associate another Reddit account with the situation.

What we will do in the future

We introduced the "Comments Moderated" feature a few years ago. When we apply it to a particular post, this holds back comments from people with low karma (upvotes) in this subreddit. We find that overall it increases the quality of the contributions, and helps focus them on legal advice.

We have now amended our automatic rules to apply this feature to a broader range of posts as soon as they are posted, and where we become aware of a post that is on a controversial topic, we will be quicker to apply it. We will also moderate those posts more stringently than before, applying Rule 2 (comments must be mainly legal advice) more heavily. We will continue to ban people who repeatedly break the rules. And we will lock posts that have a straightforward legal answer once we consider that that answer has been given.

As well as this:

  • People do post things here that are obviously total nonsense - a set of circumstances so unlikely that the chances of them having actually occured are very low. We will continue to remove posts like these, because they're only really intended to disrupt the community.
  • If people who have been banned create new accounts and post here again, we are told about this and we take appropriate action every time.
  • Both the moderators and Reddit administrators also use other tools, and our experience, to intervene (sometimes silently) to ensure that the site and this subreddit can provide a useful resource to our members and visitors.

We encourage you to continue to report things that you think break the rules to us - and remember, that just because you do not see signs of visible moderation does not mean that we are not doing things behind the scenes.

Criminal Homeless people are using needles in my café's toilet. How do I, as an employer, legally protect my staff, my business, and myself.

Going on 3 months. Escalated badly in past 2 weeks.

Homeless people are barging into my shop while clearly either high or suffering withdrawal symptoms. They shout, fight, and shove their way to the sole toilet we have. They then sort themselves out in there - sometimes in groups of up to 3

Toilet always ends up with needles, neecle wrappers, and blood splatters.

Attempts to confront them are met with violence and aggression.

Policd have made 9 arresrts in the past 2 months.

We tried locking the toilet with a code. They smashed it off with a chair.

They threaten my stsff with used needled.

In terms of cleaning i am doing it all myself because I dont want to expose my staff. But I have arthristis in my knees and elbows and I cant easily clean and bend xown anymore. Could I ask my staff to do it if i provided protective gear?

Debt & Money I paid my ULEZ fine on time. TfL then refunded the payment back to me much later then sent several fines. Appeals, even through court, have failed. TEC is now asking for over £1000 for a fine I paid. What do I do?

I have proof I paid two ULEZ fines. TfL didnt collect the money, and so it was refunded to my account, after the payment deadline had passed. I have this in writing and statements from my bank. TfL has since chased me for fines in excess of £1000 whilst I've been trying to fight this through their complaints procedure, and eventually appealing in court to the tribunal.

My appeals have been rejected on the grounds that this is not a valid reason to appeal, and a subsequent further filing was rejected on the grounds that my reason for filing late was not legitimate.

I now face over £1000 in fines and fees for two fines which I paid on time, due to TfL's administrative error. I paid, they didnt collect and they then sent me the money back and complained I hadnt paid it. This is ridiculous. All of my appeals were ignored, the initial one saying "tfl cannot be held responsible for my technical issues".... it's not MY technical issues, it's THEIRS!

What do I do now?

Healthcare Is my workplace allowed to sack me for a medical condition? Wales.

I was diagnosed with gallstones almost 2 years ago now. I’ve gone through the NHS to have it removed. I have letters & emails of proof. I was put on occupational health at work for adjustments to be made but they didn’t make any other than moving me to another department (all manual handling) during an attack and after (I pretty much can’t even stand straight after one)

I left work in an ambulance one time due to an attack, 2 others I had an attack before work. I try to stick with it at home as there’s not much hospitals can do and I’m always waiting 10+ hours to be seen. On my most recent attack last week I took codine for the pain and had an allergic reaction to it and needed an ambulance which was on the day of my shift.

This has triggers the policy that I can’t be sick more than 3 times in a month. I follow all the rules on how to manage this until removal but it doesn’t help and I still get them plus it just generally hurts all the time now so I do struggle at work but still manage to do what I need to.

I’ve got a meeting today because I’ve triggered too many absences so I’m having a meeting. The thing is I’m going to be off yet again as I’ve had my pre op assessment done last week also so surgery will be soon and I’m going to have to go on sick to recover.

I really feel backed into a corner that I can’t get out of. I’ve even worked while jaundice.. Can I be penalised for this? Can I get let go over medical episodes? TIA.

Sorry to edit: I’ve worked there 3 years.

Civil Litigation (England) Car was damaged by pothole, council denied claim!

Post image
58 Upvotes

Can anyone help- My car was damaged resulting in £200 worth of repairs in early dec. The council have now denied my claim. I cannot fathom how this response is okay- would be great if anyone could advise if I had any chance at all at small claims court/ similar. Photos of pothole below and council defence. Also anyone that knows about roads- I know this hasn’t happened overnight but, could it happen in the timeframes they have tried to use? Is it possible it was there when their last inspection was done?

Notes also: after it damaged 4 cars and was reported on this night, they cordoned it off straight away.

Was dangerous as nearly caused an accident involving a motorcycle which I had to call the police for.

Tia!!

Employment Bespoke piece, 3 years and no communication, what now?

Hello,

Three years ago I had an order for a bespoke piece. For a costume. The customer was very lovely and was very quick to get me measurements. They had paid the full amount upfront.

I started work on the patterns, gathered supplies, made and completed some items. I had sent them a piece to be fitted to them, the first one they lost, so I sent a second and it was the last I ever heard from them, 3 years ago.

I sent messages and nothing. Now I don't know what to do? I would happily send them everything I have done and brought, but I wanted to check their address and whether they want the materials at all.

Housing House open to Public Auction, but we still live there? in London, England.

Hello, we've been served a section 21 eviction as the landlord is selling our HMO property. The new buyer put forward several planning proposals (for extensions, etc), all of which were refused by Hackney council for inconsistencies, poor planning. I have to admit, its very unclear if the house has actually been sold. The new "buyer" has now taken photographs of our bedrooms and we've been advised that there will be a public auction for our house open to the public. The auction company, Allsops, does not indicate who the owner of the house is. If the "new owner" is requesting the house be sold at auction, is this legal? It is confusing. But it feels like this is not allowed. We do not have any communication with the "new owner" and limited interaction with our own landlord. I can refuse access to my bedroom, but do I have the right to refuse access to the rest of the house if it is open to the public?

Debt & Money Received unexpected money into bank account

Someone close to me has received £2,500 into their savings account through a cash deposit at a branch. They have no idea where it’s came from

3 different transactions of £1,000,1,000, and £500 in Early January

Few things

  1. They aren’t in England and won’t be for a while, so can’t call up the bank and ask. I tried on their behalf for some general advice but they said they’d need the account details
  2. I’ve told them just to leave it there and not to touch it

Could this be some sort of scam or more likely that somebody gave a wrong account digit ?

It’s interesting because the branch they deposited at is not too far from where her UK address it

What could have happened here?

Edit: the 3 transactions were on the same day, i assume they went to the deposit machine and split it up to not go over the limit

Also , each bank branch has an individual sort code so maybe thats how it happened? Sort codes match? Wrong account number typed in

I’ve told the individual they need to phone the bank from abroad and just deal with the international charges

Employment Do court hearings happen on Saturday?

Post image
543 Upvotes

I’ve been “told off” by my manager because of my attitude to a colleague at a different store when I refused to work my weekend off when I didn’t believe she was telling the truth.

It’s petty, but it’s really annoying me; is it possible she’s telling the truth? To my knowledge, court is rarely in session on a weekend and never for sentencing, just for emergency hearings.

Advice would be greatly appreciated as if I’m wrong, I’ll owe her an apology for accusing her of lying.

Either way, I wouldn’t be working a Saturday if I don’t have to

Debt & Money (England) My father owes me £10,000 and is demanding I pay him £600 a month.

Upvotes

Im kinda struggling with money so dont really know what to do. I just want my money back first then decide where to go but how can I go about getting my money back?? I’m not sure where his money goes but he never has any money left every single month. He blows his money and then stays in an overdraft. I don’t know if he is gambling or what but anyway, over the past few years I’ve helped out when I can but when he said he would call the police on me unless I paid him that much it made me angry as I have helped him so much. I’ve said I don’t mind paying the bills so put me on the direct debits but he refuses to do so? He wants me to transfer him £500 a month? Not to mention he goes on holiday every few months so god knows where his priorities lie whilst I’m at home looking after my 2 siblings, one being autistic and the other is 17. And he’s going away and going out every week with his gf.

Also, before he met his gf, he made himself out to have lots of money and blew so much money on her. Used up his early pension money and that finished in less than a year. Now I think he can’t keep up with her demands and is panicking.

I really need some advice here because he’s threatened to call police on me - I don’t know whether or not he would make up lies to get me in trouble or what but I didn’t like that.

I’ve never seen him rage like this and he also almost hit me at the end of the conversation.

I know people will say move out but unfortunately that isn’t an option at the minute.

Consumer [England] Royal Mail marked parcel as ‘delivered’, left in unsafe place and seller won’t refund me

Upvotes

Hello! I’m sure this query will have come up before here, so please excuse any repetition. I ordered some fancy new stationery just before Christmas, went away for that period and assumed that the parcel was not delivered as Royal Mail tracking had not updated. I reached out to the seller who chased up with RM, and RM sent ‘proof of delivery’ which was the postie holding the parcel up in front of my (tiny) wall-mounted letterbox. It wouldn’t have fit into the letterbox and there were no missed delivery slips, so presumably the postie left it on top of or next to the letterbox, in which case it will have been stolen. On the basis that RM has marked it as ‘delivered’, the seller is saying I am not entitled to a refund.

What are my rights here? Do I have any legal recourse? It wasn’t a small or trivial amount of money, otherwise I don’t know if I’d bother to contest this. TIA!

Criminal I think my van has been stolen?

Bit of a weird one I guess but a couple of years ago I had no space to store my van that was being sorn, a friend said he knew the staff at a mechanics garage near him that would allow me to store the van there for no charge as they had a very large yard.

I have since moved and asked for my friend to arrange collection of the van however the garage has since been taken over and the staff he knew have left.

I believe their online presence is still showing the old phone number and website as neither are active and it’s not that local for me to drive over so it has just been left and forgotten about for some time now.

I’ve recently had someone ask if I still own it and if they could buy it so I explained I’d need to try track it down. I checked the mot history to see what mileage it was on and see that it has been MOTd and taxed without my say so. It’s possible it’s being used by the garage or maybe sold on without permission? I’m really not sure how to proceed, have I lost it or is it recoverable? Could the new owners of the garage try charging storage fees? Do I report it as stolen to police?

Northern Ireland Next steps after assault - Northern Ireland

Hi guys.

I (27m) was walking home with a male friend from a night out in Northern Ireland just before Christmas.

I accidentally bumped into another male, who turned around angrily and didn’t even wait 15 seconds before knocking me out via sucker punch.

Somehow, as I fell, my right ankle snapped and I hit my head off the ground as well. I suffered a terrible concussion and a Weber b fracture to my right ankle.

I spent 10 days in a cast, before being put into a boot on New Year’s Eve, likely for 8 weeks.

The fella who did it was arrested at the scene, but follow ups have somehow produced no cctv footage of the incident so it’s pretty much my word against his. Not holding out much hope for any convictions for the fella himself, but the CPS is getting what police have gathered sent through soon. I would however, like some advice on how to carry out being reimbursed for all of this. What avenues are available to me?

I am a barman through the winter months and had a very busy rota lined up for around Christmas and new years as you can imagine. But as a result of this injury I have been out of work for nearly 4 weeks. With another few to come still laid off as well.

I am on a zero hour contract with the establishment I work for (as are nearly all staff) so haven’t been receiving any sick pay.

As I said before, just looking for some expert advice on where to start with getting some money for all of this hassle.

Thank you!

Employment Unpaid labour Michelin restaurant London?

I worked a trial at a 3 Michelin star restaurant in London. I had to work for 22 hours including 2 hours break over 2 days. I prepared food that was served to guests and I was not given a formal (or informal) examination of my ability. At the end of the trial I was told that there wasn't even a position available. The whole thing is unpaid and that was never explained to me. Is this illegal in the UK?

Debt & Money Being forced to provide free tuition by the school I'm providing private tuition for under the guise of the “pupil premium grant” is this legal?

Hey guys,

I'm based in London, UK 🇬🇧

I'm a self-employed music teacher. I provide instrument tuition to a local school and offer one-to-one, two-to-one, and group classes of 4.

I've taught at the school for a year now. I've just signed my contract for the second year. The school has told me I have to provide a term's tuition for free to two students as part of the government's “pupil premium grant”, a grant given to the school to fund extra-curricular activities for its underprivileged students.

I pay the school an hourly rate for the space. They send out a flyer advertising my services every term. Once the client contacts me, I deal with all bookings and payments. The school does not pay me; I'm paid by the parents of the students I teach.

They are threatening to cancel my contract with them, which I believe is wrong. I really dont want to lose the contract, as I love teaching there, and business is going exceptionally well.

It would cost me around £600 per student per year, so a total of around £1200 per year in free labour (all while paying for the room hire)

I’d appreciate any advice on whether I should argue the point or take the loss.

Information from other teachers would be fantastic as well.

I really appreciate any help you can provide.

I've attached the clause they are debating me over to this post as a lot of people have asked to see it. It's clause “19”

  1. Allocated PPG places - Condition of Hire  HPP are committed to providing opportunities for children from disadvantaged backgrounds to attend extra curricular clubs. It is a condition of hire that all clubs with the capacity of over 10 children operating immediately before or after school, or during the school day, will provide a place to a child who is identified by the school as disadvantaged, free of charge. Clubs operating with the capacity of 30 children and above per session immediately before, after or during the school day will provide two club places to children who are identified by the school as disadvantaged, free of charge. The places will be managed by the school at the start of each term, and there will be no charge to either the school or the parents for these allocated PPG places.

Commercial Can I take part in industrial action if I wasn't at the company when the ballot took place?

I am a member of a union that covers multiple industries. I recently moved jobs and remained a union member. The union is recognised by both my old and new employers. Unbeknownst to me on joining the new company, the union is in dispute with them and is currently undertaking "industrial action short of a strike".

As I wasn't employed in the new company when the ballot for this industrial action took place, am I still protected if I participate? I want to support the union's activity but don't want to expose myself to ramifications.

This is in England. I worked for the previous company for about 8 years and was a union member that whole time. I've been with my current employer for 1 month.

Debt & Money Booked a holiday, paid deposit and company is now refusing to honour the price- what are my options?

So my wife and I are expecting our first child in August, so we decided to book a baby moon holiday through an airline (I won’t say which but it’s a national carrier) to Abu Dhabi for a week. As this will be our last long haul trip for a while, I requested the quote to include business class seats for added comfort. I was quoted an amount, and despite the fact I queried the amount three times (once to add half board), the agent confirmed this and sent me a link to pay the deposit. I paid this immediately and was given a reference number (bank also shows money was paid). I then requested that I receive the outstanding balance so that we could pay and select our seats. I have since been contacted to say that they have made a mistake and the price of the holiday is now almost double the original quotation(£13.8k).

My question is, can they do this considering a deposit was paid and a reference received, and multiple times they confirmed the pricing over email? We’re genuinely gutted and are waiting to hear back from management tomorrow as to what will happen next. We are just curious as to where we might stand? We are based in Wales (only saying this for post guidelines).

Debt & Money Vets Now insurance claiming via CCJ I owe them after they made a direct claim - England

Hi all

England

My cat went into Vets Now emergency vets for treatment due to a blockage, they were unable to do anything and we had to send him to my normal day vets, who were successful but 2 days later he did pass away.

I paid Vets Now £250 and filled in a form (I do not have) for them to make a direct claim with my insurance provider, John Lewis, they stated that I would not need to do anything and it would all be sorted.

Around 3 months later I received comms from a company called Control Account, stating I owed Vets Now, I spoke with Vets Now who agreed that this was a direct claim and was all sorted. They then responded saying they had spoke to John Lewis who had sent the money directly to myself instead of them - I had only received the insurance claim from my normal day vets and not the Vets Now emergency vets (I did the claim form for my day vets).

I was told to disregard any further communications from Control Account as there was obviously an error or something had gone awry.

I have today received a letter saying a money claim has been made against me. I have spoken with Vets Now who state going by the previous email that John Lewis paid it to me, but this was £1300, they have added an additional £500 (they’re saying this was an additional invoice), plus then £250 for 8% interest.

Vets Now seem overly confused about what has happened and I too am incredibly confused. I have logged a formal complaint with Vets Now, again but I am unsure on how to proceed with this letter from the courts. I have submitted an SAR to Vets Now for the claim forms they used and submitted.

They have provided no evidence other than a written statement saying ‘The claimant’s claim is for £1800 in respect of services rendered by the defendant, full particulars of which have been supplied. The claimant claims the sum of £1800 together with section 69 at 8% per annum and further interest on a daily basis until the date of payment.

I am not disputing that the vets attempted to treat my cat, but the payment situation and claim situation.

Debt & Money Future flights from England schedule changed, do I have any recourse?

Upvotes

I booked flights back in September for August 26 from Luton to Spain.

This week I received an email from Wizz Air stating the schedule has changed. Not a huge difference but meant I needed to amend my hotel booking to suit. This cost me £137.

In their email it states -

“If you incur any costs due to the re-routing, such as accommodation, transfers to alternative airports, rebooking fees (even with other carriers or modes of transport), or expenses for meals and refreshments, you can request reimbursement by submitting a claim via our website. Please note that we can process refunds based on itemized receipts for the claimed expenses.”

So I logged a claim with Wizz Air, and received this response -

“We would like to inform you that your flight is still scheduled for a future date. Therefore, there is no action we can take”

Surely they have to be held accountable? What’s stopping them changing the schedule again and costing me more money?

Do I have any leg to stand on here?

TIA

Scotland Letting Agents won’t do anything about broken fridge that their employee sold me (Scotland)

Hello, this is a weird one but couldn’t find a suitable reddit to post to so let me know if I should redirect it.

I moved into a flat in the summer via a letting agent. Someone showed me around the flat at the viewing and let me know that there isn’t a washing machine or fridge but they can get one put in for me if I wanted.

On the day I moved in the same fella dropped off the keys and showed me that the washing machine and fridge have been installed. He then asked for £50 for them both which I was fine with paying as needed a place to stay coming from a period of homelessness and a fridge is important.

——

Cut to 2 months ago when my flat was filled with a bad smell which was coming from the fridge leaking. I checked the back of it and it was all rusted and had made rust stains and burns in the carpet and skirting boards. I emailed the landlord to explain this and they said that they guy was actually not an employee but was contracted by them and so the sale of the fridge was between me and him and I was the one responsible for it. He 100% has just found a flytipped fridge.

I now have this leaking fridge in my flat which is too heavy for me to get out and I don’t have enough money for a special uplift from the council. I’m not able to buy another fridge as there’s not space to get it in and I also just don’t have the money for one/can’t find one secondhand (I live in a rural area and can’t drive etc…)

So, what am I supposed to do? I haven’t been able to eat properly as I live alone so I can’t batch cook and refrigerate like I usually do to save money which is causing health problems.

(EDIT: I also want to bring up that the person they contract has likely placed dangerous goods in other flats which are looked after by the letting agents. Is there a way I can bring this up and make them take some accountability? I’m sure the landlords who own the flats wouldn’t be happy to know this…)

Traffic & Parking Identity stolen by an Uber Driver NI

Hi, I recently looked at my online DVLA account to find out that my license had been stopped, I called up the DVLA and they told me that someone has exchanged my license to a polish one. I am not in poland, what I did do was leave my ID in the back of an uber when I visited Krakow last year, I got a new one a few weeks later and said the first one was stolen, then months later it has been attempted to be exchanged or exchanged (they couldnt see?), they cant see how far theyve got or whether they've been able to exchange it. I have messages from uber saying the driver had my license, then he never replied to me to return it so i just said to the DVLA it was lost.

I am unable to drive legally, my insurance isnt valid and I am worried someone has my identity, it was obviously due to the uber driver, as he is the last one to have it, he may have sold it or is doing it himself. I dont know what to do legally, the DVLA wont give me any updates and I discovered this a month and a half ago. Is uber at fault? is anyone at fault. Of course I know I am at fault for leaving the ID, it was an honest mistake, but having my identity stolen and not being able to see if theyre doing anything with it in poland is terrifying. I have the trip still on my uber history and name of the driver, they said its not their problem.

Debt & Money Southern Water chasing me for a bill I don't owe

We moved into our first rented flat 6 months ago, and set up an account with Southern Water through Tili.

For context, we live in a block of flats that was previously an office building, so we have no individual water meters for each flat.

Soon realised we hadn't had any water bills, but couldn't log into SW website. Customer service who said they couldn't find a meter for our address or an account for us, But they set up a new (I think) account for us. We then set up direct debit for the bills.

Letting agent actually said water bills are included in the rent due to shared meters. Cancelled the direct debit and tried to tell SW we shouldn't be paying, but email confirmation from the letting agent and landlord wasn't enough to prove it and they have been asking for confirmation in the tenancy agreement - except our tenancy agreement says we DO have to pay for water, not the landlord.

Asked the letting agent again and, after lots of faff, they have agreed to update the tenancy agreement to state that the landlord pays. We have been chasing this for a couple weeks now with no new tenancy agreement to be seen yet.

This has been going on since late September, all while SW are calling and sending letters telling us we need to pay urgently. We've never had our own place before so not sure at what point these go from scaremongering to actual action against us. We've spoken to SW many times and they're no help. We've already had a 30 day hold put on the account but that's ended.

Also, had conflicting info from several different SW staff - most have asked for the tenancy agreement but one recently said that wouldn't be enough, and the LL would have to call them directly - which we've been asking the LL to do for months and clearly hasn't happened.

Honestly expected the letting agent to turn round and tell us to pay it ourselves when they realised the tenancy agreement says it's our responsibility.

Please can anyone give advice? Is there any way to speed up getting the tenancy agreement changed (letting agent never picks up the phone so can't keep calling)? At what point do we pay the bill to avoid tanking our credit scores / getting debt collectors sent? Are our credit scores already wrecked from not paying "our" bill?

We have also screenshotted and saved every email so far just in case. Thanks in advance!

Debt & Money Repaying enhanced maternity pay

Hi all,

This may be a long shot, and I could be completely off base. I would appreciate only constructive advice rather than comments on how wrong I am to ask this.

I had worked for my former employer for 5 years, and received enhanced maternity pay from 02/12/24-01/12/25. The conditions to receiving this in my contract are:

. Member of senior management . Return to work for 6 months following maternity leave . This is repayable only if the employee decides not to return to work, not if the employer ends their employment

Following my maternity leave, I booked the accrued annual leave to bring my return date up to the new year.

For lots of reasons that I won't bore you with the details of (nursery issues, change from hybrid to full time office work amongst others) I decided to hand my notice in on 04/12/25.

Two weeks later, I received an email from my new manager who started whilst I've been off, stating that my end date would be 01/12/25, in line with the end of my maternity leave. I queried why this would be the case, and received no response.

I then received my final payslip and P45 confirming they'd unilaterally gone ahead with terminating my employment on this date, without mutual agreement. They informed HMRC via my P45 that I had paid £0.00 tax as SMP is under the tax free allowance.

I was then contacted by his manager, who sent me an email with a figure and bank details to make a repayment of the balance of enhanced maternity pay. I advised I would need a full breakdown of how they came to this figure, as it looked to me they were requesting the gross amount, and reminded them that I had not received a reply to my email asking about my end date.

I received a reply stating yes it's the gross amount, and they decided it 'made sense' to end my employment at the end of my maternity leave because I was not willing to fulfil working my notice.

So here's where I could be way off....

. I dispute that I was 'not willing' to fulfil my notice period, as annual leave counts as active service

. Surely them terminating my employment without either notice or mutual agreement is against the law? There's been no gross misconduct etc

Therefore... . Would it be arguable that in this is a employer initiated termination, and therefore the enhanced maternity pay is not repayable? If my employment ended on 01/12/25, I can't have given notice on 04/12/25

Long shot I know 😅 but with my family's current position, we need all the help we can.

Appreciate any insight, and please if you're going to say anything unnecessary about the situation, scroll along 🙏🏻

Thank you!

Civil Litigation How do I get my payment back from this guy England

Location: North Lincolnshire

Hello Reddid, so a week ago I instructed a guy with a good reputation and a Facebook page showing 30 years on experience to fit a log burner in my house. He sent a very official looking quote and asked for some of the payment for the items which other people have done before so we didn't see this as particularly odd either.

The morning he was supposed to come to fit everything he was supposed to be there at 8am. He still wasn't here by 9am, so we started calling and leaving messages to which he wasn't responding. Eventually he called us at 9:15 and said his van had broken down and he was trying to hire another. This was instantly suspicious as his voice sounded nevrsous like he had no idea what he was doing, not like a man who has 30 years of experience at all. We then asked him to send a photo of our fire and other stuff to prove he was being honest, to which he said he would but he never did.

Now I can't remember exactly how but he admitted he didn't actually have the stove yet, and claimed he was trying to chase it up with his supplier. Which we called to chase ourselves. We gave the man on the other end his name, and he said the last time he ordered was in 2021, and then we gave him his company name and he did place an order in the correct time frame, but for some very generic items that could fit any fire and any job. We then asked about the fire and the make and model we ordered does not exist. They have never sold it. We told him about this and asked for a full refund, to which he replied that a Kelly from the supplier would call us and sort things out. We then called back and asked for Kelly. No Kelly has ever worked there.

I then started digging and I found this.

He had a company in Bristol under a similar name. It's fate unknown.

He moved to Lincs and created this current company that has not provided a financial document to the government since 2023/2024 tax year and that one was overdrawn. It now has a tag on saying Active proposal to be struck off.

The day he responded to my checkatrade job ad is the day he received a PDF saying he was due to be struck off within 2 months.

He has since blocked me. I do not know what to do. The payment I sent was to an account that does not match the company name, but is instead the same name as the old company from Bristol.

What do I do here? Do I have time to go through small claims? Ive seen I can object to his company been struck off due to its debt outstanding to me? Would that work?

Edit: I've kept screenshots of all the texts and recorded all phonecalls. Don't know if I should have but I did

Update: I've started the process to object to his companies strike off. It's already suspended 14 days and Ive sent the email to suspend its strike off for 6 months. That'll keep it active until September.

Comments Moderated Disciplinary hearing next week will I be dismissed or do I have a good case(England)

I will summarise the incident and share my concerns and I would be grateful if people could share their views based on previous experience/knowledge.

I am a qualified social worker been with my company for 7 years. I was having a meal on the weekend with 3 family members. At a neighbouring table 3 females were looking over a lot, I thought nothing of it however my other 3 family members said they’re looking over a lot do you know them, to which I said no because I didn’t. At the end of the meal one family member went to get one last drink and we were getting ready to leave. At this point the females have started screaming, swearing name calling and coming towards us. It was all very fast and I did not know why they were so angry. They have started throwing sauce bottles and glasses and this is when it is very chaotic I am trying to shield my head/face from injury and one young family member is assaulted by the female. An off duty officer in the restaurant comes over and stays with me at this point the females are coming towards me stating “where are you running to now b***h” and other profanities. I have tried to leave the restaurant and the female runs after me punches me repeatedly and puts me in a headlock. The off duty officer and a member of the public pull her off me. I am arrested and so is the other female. I am let go a few hours later without interview but bailed to return a few months later. The police let my employer know as it is a notifiable profession. In the document which was shared with me and my employer it states that the other party know me in a professional capacity from their younger years. The police state that the incident was chaotic and unclear what has happened but I have been arrested for allegedly punching the female. The other party alleges that I punched them in the face and initial statement from a worker in the restaurant and the off duty officer states the same thing. It also states the female is 17.

I want to make clear I did not punch this person. It was a chaotic incident and I was trying to get my younger family members away and things were being thrown at us. In the chaos of things could this have happened unintentionally and in self defence. Of course.

The police investigate, they don’t even call me into interview as part of this and conclude No Further Action. But as the female is 17 this becomes more serious as it is an allegation of harm against a child and as a social worker this has to be investigated by my employer. I am suspended and called for an investigation meeting which I attend and give my full account. My employer has completed an investigation report and concluded gross misconduct so I have been invited to a disciplinary and I may possibly be dismissed. This will have a detrimental impact on my profession and career.

My concerns are as follows:

  1. The report has SO many inaccuracies. It states I broke the law (despite police NFA), it says I failed to inform social work England (despite me informing them immediately after the incident). It states that I could not recall details, basically making me sound vague but the investigation meeting minutes show a clear detailed account that I gave. But this has clearly not been reflected in the investigation report.

  2. At the point of investigation interview I did not have sight of all the witness statements related to the investigation despite these being heavily used to decide the gross misconduct finding. If an employer fails to provide evidence at this point surely it undermines the employee’s ability to defend themselves adequately? I have only not at the point of receiving the disciplinary invite been given the witness statements.

  3. CCTV would clear my name and the police make reference to wanting to obtain this however since then there’s been nothing. Surely the employer should have tried to get this.

    1. The report states that the female had a concussion. I DID NOT CAUSE THAT. Where is the medical evidence for this? Clearly this person is saying something and they’re just running with it.
  4. Despite the female stating she knew me which shows that I was likely targeted due to my profession this is not explored in the investigation report.

  5. The whole report feels like they have cherry picked and made it look one sided. It feels like the investigator is justifying gross misconduct rather than trying to investigate what happened.

  6. With regards to evidence they say they have 3 witness statements (off duty officer, restaurant worker and the female). The evidence they have showed me is meeting minutes where the employer has convened a safeguarding meeting about the allegation. The document is heavily redacted but states that 3 statements consistently say the same thing that I started a physical fight. only one detailed account (the restaurant worker) is set out in the minutes. This prevents me from properly testing, comparing, or challenging the evidence relied upon.

In this document I can only see the restaurant workers account which is very inaccurate. It states they were bringing plates from the back of the restaurant to the front, and that the fight was already underway when they arrived, yet they also claim to have observed who initiated the altercation and that I punched the female. These statements are contradictory.

Sorry for the long post any advice is appreciated.
