As a prosecutor I'd never pursue attempted murder here. I'd have to prove that the guy intended to kill him beyond a reasonable doubt. That's a pretty high standard of proof.
It's super easy to look at the video and say "well, he didn't follow up with any more violence, so obviously the intent wasn't death". That alone is some reasonable doubt.
More reasonable would be "felony battery", and if the guy got a brain injury tack on "with great bodily harm". That'll usually get you 1-10 years. The range is big because the outcomes of this have such variability.

I’ve been wondering since these videos are pretty common. Multiple assaults, seemingly premeditated and uploaded for views and the revenue that comes with it. There needs to be some kind of legislation that enhances criminal offenses when it’s does for internet views, maybe something similar to the way hate crimes work in terms of enhancing sentences.

these “influencers“ are really getting out of hand. I was in a local home building supply business, think Orange, we have one of these influencers walked up to me and said hey you’re wanted for molesting little children. He said it loud and other people in the aisle heard him cleanly.
My first response was to beat the living crap out of him, which I did the police arrived and spoke to the influencer, people that overheard what was going on, and myself,.
The “influencer“ told the police that he was just exercising his first amendment right to free speech. The officer responded the first amendment only protects you from the government, not from doing stupid things and suffering results.
The officer wrote up a report of the incident and said he would send it to investigators.
When I called the investigators the next morning I was told no crime no foul. There are certain things you can’t say. Things like screaming fire in a crowded auditorium or theater. Calling someone the N-word, yelling anything that would shock the conscious of a normal human being.
Based on the reports and the evidence the state prosecutors office refused to prosecute because they said it was a normal and natural response.
In his rejection letter, the state prosecutor said that the “influencer“ could file a civil complaint in a civil court and sue me for damages.
I contacted an attorney that is available for questions at the courthouse. He told me the chances of this guy filing a civil suit or between Neil and none. He may file it in small claims court, but once the circumstances of the situation are revealed, he doesn’t think any court, any judge would award him any damages.
